On Tuesday, 18 August 2009 Commissioner S J Kenner issued his decision and order in Leahy v. Liquor, Hospitality and Miscellaneous Union. At issue was the implied duty of trust and confidence between an employee and an employer, and whether the applicant’s conduct had breached this duty. The application was dismissed as it was found that the Union’s decision to terminate the applicant’s employment was not unlawful nor harsh, oppressive or unfair.
