Online Lodgement

Welcome to the Commission's on line lodgement page.

You may complete and lodge many of the Commission's Forms on line instead of posting a copy of the Form to us or coming in to the Registry to lodge the Form personally.

However for the time being, Forms relating to proceedings to be heard in the President's jurisdiction or before the Full Bench cannot be lodged on line.

Who May Lodge on Line

You should be aware that in general terms, only unions (registered employee organisations), employers, and employer associations (registered employer associations) may lodge claims in the WA Industrial Relations Commission. There are some exceptions however; an employee may lodge a Notice of Application claiming:

  • to have been unfairly dismissed (see section 29(1)(b)(i) of the Industrial Relations Act).

    Please note such claims must be referred to the Commission within 28 days of the date the employment terminated. Claims lodged after that date may not be accepted and must be accompanied by a Statement setting out the reasons for the late lodgement.

  • to have not received a benefit to which the employee is entitled under the contract of service (see section 29(1)(b)(ii) of the Industrial Relations Act)), and

  • an entitlement to long service leave (see section 44(7) of the Industrial Relations Act).

A respondent to a claim in the Commission may complete and lodge a Notice of Answer on line.

Statutory Declaration of Service

A Declaration of Service requires the maker to declare it before a witness in accordance with the Declarations and Attestations Act, 1913 (see regulation 47(2) of the Industrial Relations Commission Regulations 2005.) This cannot be done on line. However a copy of the Declaration of Service Form 4 may be downloaded from the Commission's website here and completed. Once completed, it may be lodged on line, providing you have already lodged an application on line, by copying its details (including the details of the person witnessing) onto the on line Form. The original Form should be retained for production later to the Commission if required.

You Must Register to Lodge On Line

To complete and lodge a Form on line requires that you register by registering and using a "username" and a password. This is required as a measure of security and privacy. Persons or organisations who regularly represent parties will be able to use the same username and password to complete and lodge forms relating to different applications. Payment of Fees

The on line process will indicate whether a fee is payable. If a fee is payable, payment may be made on line by credit card. Forms may be lodged on line and the fee later paid in person, but the fee must be paid within 7 days of lodging the Form on line.

Rejection of Forms

All Forms lodged on line are checked by the Registry prior to them being accepted. Forms that are incomplete or otherwise not permitted under the Industrial Relations Act or the Industrial Relations Commission Regulations 2005 will not be accepted. In those cases, the person attempting to lodge the Form will be advised by the Registry.
