Order

WHEREAS this is an application pursuant to s 80E(2) of the Industrial Relations Act 1979 (WA);

AND WHEREAS on 17 August 2021, the respondent wrote to the Public Service Arbitrator (Arbitrator), advising that it seeks an additional seven days to comply with Order 1 of [2021 WAIRC 00458];

AND WHEREAS on 17 August 2021, the applicant wrote to the Arbitrator in response to the respondent’s request, advising that she would feel prejudiced if an extension was granted to the respondent;

AND WHEREAS on 17 August 2021, the respondent wrote to the Arbitrator in response and advised that it does not object to the Arbitrator also granting an additional week to the applicant to comply with Order 2 of [2021 WAIRC 00458];

AND WHEREAS on 17 August 2021, the Arbitrator considered the correspondence and made some changes to the proposed request to extend the filing timeframes;

NOW THEREFORE the Arbitrator, pursuant to the powers conferred under the Industrial Relations Act 1979 (WA), hereby orders –

1. THAT Order 1 of [2021 WAIRC 00458] be amended to say “THAT the respondent file its submissions, any documents upon which it intends to rely and statements of the evidence of any witness upon which it intends to rely at the hearing of the matter by no later than 5:00 pm on 27 August 2021.”.

2. THAT Order 2 of [2021 WAIRC 00458] be amended to say “THAT the applicant file her submissions, any documents upon which she intends to rely and statements of the evidence of any witness upon which she intends to rely at the hearing of the matter by no later than 5:00 pm on 10 September 2021.”.
