WHEREAS on 19 December 2023, the applicant, Local Government, Racing and Cemeteries Union (WA) (LGRCEU) applied to the Commission to convene a conference pursuant to s 44 of the Industrial Relations Act 1979 (WA) concerning a dispute in relation to an industrial matter;

AND WHEREAS the Commission convened conferences on 21 December 2023, 22 January 2024 and 15 February 2024;

AND WHEREAS at the conclusion of the conferences, the dispute in relation to the industrial matter had not been resolved by agreement;

AND WHEREAS the industrial matter is, therefore, to be referred for hearing and determination;

NOW THEREFORE, the Commission pursuant to the powers conferred under the Act and regulation 31 of the Industrial Relations Commission Regulations 2005 (WA), and for the purpose of drawing up a memorandum of the matters requiring hearing and determination, hereby directs –

1. THAT the applicant file a statement of claim by no later than 28 February 2024.

2. THAT the respondent file a response by no later than 15 March 2024.
