Order

WHEREAS on 13 February 2024, the Local Government, Racing and Cemeteries Union (WA) filed an application to vary the Municipal Employees (Western Australia) Award 2021 pursuant to s 40 of the Industrial Relations Act 1979 (WA);

AND WHEREAS on 16 February 2024, all named parties to the Award were served with a copy of the application;

AND WHEREAS pursuant to the Act, any respondent who desires to contest the claim or any provision sought by the applicant must file a response within 14 days of the time endorsed on the notice of application;

AND WHEREAS on 19 February 2024, Chambers wrote to the applicant requesting the applicant to provide a schedule to the application setting out how it has calculated the proposed allowance at clause 19.5 of the Award and the grounds for the application;

AND WHEREAS on 27 February 2024, Chambers wrote to the applicant advising that Senior Commissioner Cosentino was inclined to issue an order to extend the time for any response(s) to be filed within 14 days following receipt of the applicant’s particulars of the grounds for the application unless there was any objection;

AND WHEREAS on 27 February 2024, the applicant advised that it had no objections to the proposal;

NOW THEREFORE, the Commission, pursuant to the powers conferred under the Act hereby orders –

THAT the time for any respondent to file a response to the application be extended to 14 days following receipt of the applicant’s particulars of the grounds for the application.
