HAVING heard from Mr K Trainer on behalf of the Applicant, and Ms K Groves of counsel on behalf of the Respondent, the Commission, pursuant to the powers conferred on it by the Industrial Relations Act 1979 (WA), hereby directs –

1. THAT the Applicant, no later than 4.00PM on Friday 26 April 2024 file:

a.  A statement of claim;

b.  An outline of submissions in support of the statement of claim;

c. An outline of evidence for each witness that it intends to call in the matter, such outlines to comply with Practice Note 9 of 2021; and

d. Copies of all documents and any other material upon which it intends to rely in the proceedings.             
 

2. THAT the Respondent, no later than 4.00PM on Friday 17 May 2024 file:

a. A response;

b. An outline of submissions in support of the response;

c. An outline of evidence for each witness that it indents to call in the matter, such outlines to comply with Practice Note 9 of 2021; and

d. Copies of all documents and any other material upon which it intends to rely in the proceedings.

3. THAT the Applicant, no later than 31 May 2024 file any material upon which it intends to rely in response to the material filed by the Respondent.

4. THAT the matter be set down for hearing for two days on a date to be fixed.

5. THAT each party shall have liberty to apply at short notice.
