WHEREAS this matter is a review of the Farm Employees’ Award scope pursuant to s 37D of the Industrial Relations Act 1979 (WA);

AND WHEREAS on 21 November 2023, the Commission in Court Session issued an order varying the Award as contained in Schedule 1 and Schedule 2 ([2023] WAIRC 00912);

AND WHEREAS the variations in Schedule 1 of the order took effect from the date of the order and the variations in Schedule 2 were to take effect from a date to be fixed, not before the determination of APPL 58 of 2022, being a review of Award pursuant to s 40B of the Act;

AND WHEREAS on 26 March 2024, orders were made finally determining APPL 58 of 2022 by making variations to the Award with effect from 1 July 2024 ([2024] WAIRC 00135);

NOW THEREFORE the Commission in Court Session, pursuant to the powers conferred on it under the Act, hereby orders –

THAT the variations to the Farm Employees’ Award which are the subject of order 2 of the Commission in Court Session’s Order issued on 21 November 2023 ([2023] WAIRC 00912) are to take effect from 1 July 2024.
