WHEREAS a Direction was issued on 6 March 2024 in respect of programming the matter for the substantive hearing ([2024] WAIRC 00093);

AND WHEREAS on 10 April 2024, counsel for the respondent advised that an appeal has been lodged in the matter, and therefore sought for the programming directions and substantive hearing to be vacated;

AND WHEREAS on 10 April 2024, the applicant confirmed it concurred with the respondent’s correspondence;

AND WHEREAS, on 10 April 2024, the Public Service Arbitrator considered the correspondence;

AND NOW THEREFORE, the Arbitrator, pursuant to the powers conferred on it under the Industrial Relations Act 1979 (WA), and by consent, hereby orders –

1. THAT the 5-day hearing listed on Monday, 27 May 2024, to Friday, 31 May 2024 be vacated.

2. THAT the Direction issued on 6 March 2024 ([2024] WAIRC 00093) be vacated.
