Order

WHEREAS on 29 August 2023, the applicant filed a Form 2 – Unfair Dismissal Application;

AND WHEREAS on 20 September 2023, the respondent filed a Form 2A – Employer Response to Unfair Dismissal Application;

AND WHEREAS on 29 September 2023, the Commission convened a conciliation conference and the parties agreed to settle the matter on terms including that the applicant would discontinue the matter by filing a Form 1A – Notice of Discontinuance by 10 October 2023;

AND WHEREAS the applicant did not file a Form 1A – Notice of Discontinuance to discontinue the matter;

AND WHEREAS on 19 April 2024, the Commission wrote to the parties informing them that given the length of time since the parties agreed to settle the matter, the Commission will issue an Order dismissing the matter on 26 April 2024 unless an objection is raised before then;

AND WHEREAS by 26 April 2024, no objection was received by either party;

NOW THEREFORE, the Commission, pursuant to the powers conferred under the Industrial Relations Act 1979 (WA), hereby orders –

THAT application U 61 of 2023 is dismissed.
