Appeal termination of apprenticeship

Overview

An apprentice can make an appeal to the Commission against the decision of the Chief Executive Officer of the Department of Training and Workforce Development to cancel or terminate the apprentice’s training contract (apprenticeship).

Critical Information

The appeal must be filed within 14 days of the date of the decision, using Form 8C – Notice of Appeal or Referral (Other Matters).

Appeals of this nature may be filed by the apprentice or the employer under s 60F or s 60G of the Vocational Education and Training Act 1996 (WA).

Process

After you file the appeal, the Registrar will serve a copy of the notice of appeal on each of the parties, other than the appellant.
The matter may then be listed for a hearing where the Commission will make a binding decision.

Possible outcomes

The Commission can confirm the decision of the Chief Executive Officer, set it aside and substitute it with a decision that the Chief Executive Officer could make, or order the Chief Executive Officer to decide the matter again.
