HAVING heard from Mr R Hinkley, applicant, and Ms M Farrar, of counsel on behalf of the respondent, the Commission, pursuant to the powers conferred under the Industrial Relations Act 1979 (WA), hereby directs –

(1) THAT by 19 December 2025 the applicant is to file:

a. an outline of the evidence of each witness whose evidence the applicant will rely upon at the final hearing of this matter. Each outline of evidence must comply with Practice Note 9 of 2021.

b. a bundle containing each document which is in the applicant’s possession or control, and which the applicant will rely upon at the final hearing of this matter;

(2) THAT by 19 January 2026 the respondent is to file:

a. an outline of the evidence of each witness whose evidence the respondent will rely upon at the final hearing of this matter. Each outline of evidence must comply with Practice Note 9 of 2021;

b. a bundle containing each document the respondent intends to rely upon at the final hearing of this matter, except documents that are included in the applicant’s bundle; and

(3) THAT there be liberty to apply
