WHEREAS the Commission, being of the opinion that the following employer named in the Shop and Warehouse (Wholesale and Retail Establishments) Award 1977 no longer carries on business as an employer in the industry to which the award applies did give notice on the 23rd day of March, 2006 of an intention to strike out that employer as a party to the award;
AND HAVING read and considered the documents relating to this matter there being no party desiring to be heard in opposition thereto, and upon being satisfied that the requirements of the Industrial Relations Act, 1979 ("the Act") have been complied with, I, the undersigned, Chief Commissioner of the Western Australian Industrial Relations Commission, acting on my own motion in pursuance of the powers contained in section 47 of the Act, do hereby order and declare
THAT from the date of this order, Nevarda Shirt Co Pty Ltd be struck out of Schedule "C" – Respondents of the Shop and Warehouse (Wholesale and Retail Establishments) Award 1977.
