HAVING heard from Mr Farrell on behalf of the applicant and Mr Carroll on behalf of the respondent, the Commission, pursuant to the powers conferred on it under the Industrial Relations Act 1979 (WA), hereby directs –

1. THAT the question of whether the Commission has the necessary jurisdiction to conciliate and arbitrate this application be determined as a preliminary matter;

2. THAT the respondent’s Form 1A Application filed on 26 May 2025 and served on 27 May 2025 be the respondent’s submissions;

3. THAT the applicant file and serve any written outline of submissions by no later than 18 September 2025;

4. THAT the respondent file and serve any written outline of submissions in reply by no later than 2 October 2025;

5. THAT the hearing be conducted on the papers unless one or both parties request a hearing within 7 days of the respondent’s submissions in reply having been filed and served; and

6. THAT the parties have liberty to apply on short notice.
