WHEREAS on 11 July 2025 the applicant filed a Form 2 – Unfair Dismissal Application (application);

AND WHEREAS on 25 August 2025 the respondent filed a Form 2A – Employer Response to Unfair Dismissal Application (response);

AND WHEREAS it was apparent from both the application and the response, that the applicant was employed by a national system employer;

AND WHEREAS a Notice of Listing was issued on 18 September 2025, scheduling the application for a conciliation conference on 2 October 2025;

AND WHEREAS Mr Collins appeared on the respondent’s behalf but there was no appearance by the applicant;

AND WHEREAS the Commission, because the respondent is a national system employer, would have no jurisdiction to deal with the application;

NOW THEREFORE, the Commission, pursuant to the powers conferred under the Industrial Relations Act 1979 (WA), hereby orders -

THAT the application is dismissed.
